The internet is still growing rapidly, more and more people get on the information highway and even more businesses offer goods and services online. No wonder then, that the number of Internet related litigation has soared. But since there is no universally applicable internet law, is there truly someone who can claim to be an Internet law expert?
Yes, they can claim that, but in reality, they can only claim expertise for the jurisdiction where they are permitted to practice law. Internet is an international behemoth encompassing the whole world. Litigation for Internet cases is very tricky and starts with the definition of the jurisdiction. Where do you go to sue someone who has an Internet presence, sub-companies, a company in the real world and branch offices throughout the world, plus headquarters in a different country than the claimant, add to this mess that the server where the objected transaction took place being located in a third country, perhaps even on an exotic location and just defining the authority will keep you in courts for a couple of years.

There is no Bible on Internet law. There is an unlimited number of references and cross references pointing out to certain regulations, but a book where all of it is written does not exist, no matter how big they write it on the cover. But on local level, perhaps even on per country level, serious Internet law experts can be found. But for cases where the jurisdiction lies in Germany, France, China or Turkmenistan, they would be the wrong people to call.
Just like it is hard to pinpoint the jurisdiction for certain cases, it will be hard to define the Internet law expert who can help with the case. But once the authority has been defined, there is no further obstacle for finding a real Internet law expert to handle the case. It should nevertheless be noted, that for cases where an infraction is actually being prosecuted on an extension of an existing law but the crime was actually perpetrated on the Net, a regular law expert may be more suitable.

Sometimes is the Internet craze really funny. Just like in this case, for Internet E-commerce law, the biggest issue is jurisdiction. A worldwide outlet, which Amazon is, has affiliates and branch offices throughout the world. But Papa Giorgio’s Pasta in Italy has only one Internet store and is a worldwide business just the same.
There is no law which can encompass every single case that is possible to happen over the Internet. Before the Internet, international cases were seldom happening. Import and Export was clearly regulated, in the purchase contract was the jurisdiction defined, all done. But today, with millions of businesses on the Internet actively trading cross-border, international litigation is booming just in the same proportion. The legislature is trying to follow up with regulations and adjustments, in order to make the whole mess easier, but what they’ve accomplished is actually the opposite. The whole Internet law, of which E-commerce is a very big chunk, is a worldwide mess. Instead of simplifying the process, like it was back in the days of import-export businesses and equalize the procedure, the legislative body, just because of the prospective tax income, is mudding the waters.
